What to Do After a Motorcycle Accident

  • At the scene of the accident, make sure the police know that your motorcycle headlight was operable. In nearly every motorcycle make and model built over the past several decades includes a system that operates the headlight automatically while the engine is running.
  • Do not make any harmless comments at the scene. Even saying anything about regretting that the accident happened may be used by the other driver as an admission of your liability.
  • Do not talk to the car driver or passengers involved in the accident. Give your report of events only to police officers at the scene, out of hearing-range of others at the scene. If there are witnesses at the scene, make sure police get all contact information.
  • Do not remove or move pieces of evidence from the scene. If you have a camera available (including your cell phone), take pictures of the exact position and condition of the vehicles involved. But do not get in the way of police conducting their investigation.
  • Go to a doctor, even if it does not appear that you have serious injuries. Even a slight bump to the head or twisted back can result in a serious head or spinal injury. There is no relationship between a low impact crash and the severity of injuries. Symptoms may not fully show up for days or weeks following the accident.
  • Do not repair or ride the motorcycle until a qualified lawyer inspects it and gives approval. When you get control of your bike, keep it secured and untouched in a safe place until your attorney clears you for repairs.
