The Federal Motor Carrier Safety Administration (FMCSA) was established in 2000 as a department within the U.S. Department of Transportation. Its function is to oversee commercial motor vehicle (CMV) usage on our nation's roads and highways. Its primary responsibility is to ensure truck company and truck driver compliance with the provisions of the Federal Motor Carrier Safety Improvement Act of 1999. The FMCSA currently employs about 1000 overseers, with offices in all 50 states.

In the event of an accident involving a CMV, violations of FMCSA regulations typically trumps comparable negligence that may be assigned to the driver of the privately-owned car or motorcycle involved. Even if the car driver is shown to be at fault for causing the truck accident, the truck company may share liability for some damages, if it can be shown that the truck or driver were in violation of specific federal regulations.
